Liability Waiver and Media Release

A signed version of our liability waiver and media release must be submitted electronically via the Living Well Mindbody app. Waivers must be signed in order to participate either through a desktop or mobile app submission.

Desktop: When new clients create an account in the desktop version of the Living Well Mindbody site, they must agree to the liability waiver terms when they create their account. A copy of the waiver will not be saved to the new client’s account but the record of the client’s agreement and the time and date they agreed to the waiver is found in the “Additional Information” section of the “Client Info” screen.

Mobile App: Depending on the version of the app being used, the client will either be asked to agree to the waiver when initially creating an account, or when booking their first class. The newest versions of MindBody branded mobile apps include the ability to sign the waiver, which is then uploaded (with a physical signature) to the “Client Documents” section of the “Client Info” screen.

Liability Waiver

Participation in Living Well programming and activities is voluntary and involves certain inherent risks. The use of equipment, online content, facilities, and premises of Texas A&M University by persons participating in wellness activities shall constitute acceptance of that risk regardless of the nature of the injury. The participant must agree that the Texas A&M University System, Texas A&M University, its officers, employees, and agents shall not be liable for any injury, loss, or damage sustained or suffered by persons participating in online content or activities sponsored by the University, whether caused directly or indirectly by the negligence or fault of the Texas A&M University System, Texas A&M University, Living Well at Texas A&M University, the Division of Human Resources and Organizational Effectiveness, its officers, employees, or agents. Living Well activities and programs do not constitute any part of a participant’s official duties, responsibilities, and is not considered to be within the course and scope of their employment with the Texas A&M University System, Texas A&M University, its agencies, institutions, and services. Participants must understand that it is their sole responsibility to determine if they are physically capable of engaging in any activity available through Living Well at Texas A&M and that they are aware that no emergency-trained personnel or medical equipment is available on-site. Individuals not having health coverage are strongly advised to acquire health insurance before exposing themselves to possible injury. Living Well recommends following best practices related to the prevention and spread of COVID-19. For the most up-to-date

Media Release

I consent to and allow any use and reproduction by Texas A&M University’s Employee Wellness Program of any and all photographs or videotapes taken of me during my participation in this activity. I understand that Texas A&M University’s Employee Wellness Program will own the photographs and videotape and the right to use or reproduce such photographs or videotape in any media, as well as the right to edit them or prepare derivative works for the purpose of promotion, advertising, and public relations. I hereby consent to this use of my name, likeness, or voice and I agree that such use will not result in any liability for payment to any person or organization, including myself. In signing this Sign-in and Informed Consent for Participating in Physical Activities document, I affirm that I have read, accept, and understand this form in its entirety. I know that there may be risks associated with physical activity and willingly accept those possibilities. I take full responsibility for my own health and safety in participating in the physical activity and to the extent I deem advisable, will consult a physician before participating in any of the activities.
