OUR TERMS AND CONDITIONS

Participation in Living Well programming and activities is voluntary and involves certain inherent risks. The use of equipment, online content, facilities, and premises of Texas A&M University by persons participating in wellness activities shall constitute acceptance of that risk regardless of the nature of the injury. The participant must agree that the Texas A&M University System, Texas A&M University, its officers, employees, and agents shall not be liable for any injury, loss, or damage sustained or suffered by persons participating in online content or activities sponsored by the University, whether caused directly or indirectly by the negligence or fault of the Texas A&M University System, Texas A&M University, Living Well at Texas A&M University, the Division of Human Resources and Organizational Effectiveness, its officers, employees, or agents. 

Living Well activities and programs do not constitute any part of a participant’s official duties, responsibilities, and are not considered to be within the course and scope of their employment with the Texas A&M University System, Texas A&M University, its agencies, institutions, and services.

Participants must understand that it is their sole responsibility to determine if they are physically capable of engaging in any activity available through Living Well at Texas A&M and that they are aware that no emergency-trained personnel or medical equipment is available on-site.  Individuals not having health coverage are strongly advised to acquire health insurance before exposing themselves to possible injury. 

Living Well recommends following best practices related to the prevention and spread of COVID-19. MEDIA RELEASE

Participants consent to and allow any use and reproduction by Living Well at Texas A&M of any and all photographs or videotapes taken during participation in wellness activities. Living Well at Texas A&M will own the photographs and/or videotapes and the right to use or reproduce such photographs or videotapes in any media, as well as the right to edit them or prepare derivative works for the purpose of promotion, advertising, and public relations.

I hereby grant Living Well at Texas A&M, The Texas A&M University System, and its employees and agents (“A&M System”) the irrevocable and unconditional right to use, record, edit, transmit, publish, and display my name, image, likeness (still or moving), and words (written or spoken) for education, publicity, marketing, promotion, and any other legal purpose related to the mission of the A&M System, in any medium whether now known or invented later.

I waive any right that I may have to inspect or approve the finished product in which my name, image, likeness, or words are used.

I waive any claim or right I may have in any associated copyright, which A&M System will own.

I do not expect compensation for the use of my name, image, likeness, or words.

I release the A&M System from any liability related to the use, recording, editing, transmission, publication, and display of my name, image, likeness, or words.

I understand that by signing this release I am releasing certain of my legal rights, and that if I have any questions about these rights or this release I should consult my attorney before registering.

I am at least 18 years old, or if I am under 18 years old, my parent or legal guardian has signed the necessary paperwork to allow participation.
